1. Introduction and Acceptance

Versa Conversations GmbH ("we," "our," "us," or "Company") provides AI-powered speech training services through our platform at versa.training (the "Platform").

Acceptance of Terms

By creating an account or using the Versa Platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Platform. We reserve the right to modify these terms at any time. Continued use after modifications constitutes your acceptance of the updated terms.

2. Platform Status and Beta Features

Beta/Testing Phase

The Versa Platform is currently in active development and testing phase. We continuously evolve features, functionality, and services based on user feedback and technical improvements.

What This Means:

  • Features and functionality may change without notice
  • Uptime is not guaranteed during this phase
  • Data structures and user interfaces may be modified
  • Some features are experimental or incomplete

Educational Purpose Only

The Versa Platform is designed as an educational tool for professional communication training. AI-generated feedback, assessments, and recommendations are:

  • Educational guidance only, not professional advice
  • Not a substitute for formal training, certification, or professional credentials
  • Subject to limitations in AI accuracy and understanding

3. User Eligibility and Account Responsibilities

Age Requirement

You must be at least 16 years old to use the Versa Platform. By creating an account, you represent and warrant that you meet this minimum age requirement.

Account Accuracy

You are responsible for:

  • Providing accurate, complete, and current information when creating your account
  • Maintaining the confidentiality of your password and account
  • Notifying us immediately of any unauthorized access to your account
  • All activities that occur under your account

Account Termination

We may terminate your account at any time, with or without cause, during the testing phase. Upon termination:

  • Your access to the Platform ceases immediately
  • Your data will be deleted according to our Privacy Policy timeline (within 30-90 days)
  • You remain responsible for any actions taken before termination

4. Acceptable Use Policy

Prohibited Content and Behavior

You agree NOT to:

Real Sensitive Data:

  • Input real patient data, health information, or medical records
  • Input actual personal health information or genetic information
  • Input real political opinions, religious beliefs, or racial/ethnic origin data
  • Input payment information, financial account numbers, or social security numbers
  • Input real credentials, passwords, or authentication tokens

Harmful Use:

  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Interfere with Platform security or functionality
  • Conduct automated testing or scraping without permission
  • Use the Platform for illegal purposes or to violate any laws
  • Harass, abuse, or threaten other users
  • Upload malware, viruses, or malicious code

Intellectual Property:

  • Violate any copyright, trademark, or intellectual property rights
  • Use content from the Platform in ways that infringe third-party rights

Commercial Use:

  • Resell or redistribute Platform access
  • Use the Platform for commercial purposes without explicit permission

Automated Detection

We implement filters to detect and flag potential real sensitive data. Flagged content is:

  • Excluded from AI training datasets
  • Retained temporarily (not used for model improvement)
  • Deleted within 30 days

5. Content and Intellectual Property

Your Content

Content you create on the Versa Platform includes:

  • Custom training scenarios and prompts
  • Conversation setups and persona definitions
  • Custom feedback templates and assessment criteria

Your Rights: You retain ownership of content you create.

License to Us: By creating or uploading content to the Platform, you grant Versa a worldwide, non-exclusive, royalty-free license to:

  • Use your content to provide the Platform services
  • Use your content for AI model training and improvement (consistent with our Privacy Policy and opt-out rights)
  • Create anonymized synthetic examples from your content

Platform Content

All Platform content including:

  • AI conversation responses and feedback
  • Assessment algorithms and evaluation tools
  • Training materials and scenario templates
  • Platform design, code, and functionality

Ownership: These are owned by Versa or our licensors. You may use them solely for your personal training and development on the Platform.

Restrictions: You may not:

  • Copy, modify, or distribute Platform content
  • Reverse engineer or attempt to extract our AI models
  • Use Platform content outside the Platform without permission

AI-Generated Content

Feedback, assessments, and responses generated by our AI are:

  • Provided as educational tools
  • Subject to AI accuracy limitations
  • Not guaranteed to be error-free or comprehensive
  • Created using patterns learned from user conversations (pseudonymized)

6. Limitation of Liability

NO WARRANTIES

THE VERSA PLATFORM IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Merchantability, fitness for a particular purpose, or non-infringement
  • Uninterrupted or error-free operation
  • Accuracy or reliability of AI-generated content
  • Absence of bugs, viruses, or harmful code

LIMITATION OF DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERSA SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, or consequential damages
  • Loss of data, profits, revenue, or business opportunities
  • Damages arising from use or inability to use the Platform
  • Damages from AI feedback, assessments, or recommendations
  • Damages from unauthorized access or data breaches

This limitation applies even if Versa has been advised of the possibility of such damages.

EXCEPTIONS

These limitations do not apply to:

  • Our liability for personal data breaches (covered by data protection laws)
  • Gross negligence or willful misconduct
  • Liability that cannot be limited by law

7. Data and Privacy

Your Data

Your use of the Versa Platform is governed by our Privacy Policy, which you should read carefully. By using the Platform, you agree to:

  • Our collection and processing of your data as described in the Privacy Policy
  • Your conversations and feedback being used for AI model improvement (with opt-out rights)
  • Temporary storage of flagged sensitive content (deleted within 30 days)

Data Deletion

Upon account termination:

  • Your account data is deleted within 30-90 days
  • Conversation transcripts are deleted according to the retention schedule in our Privacy Policy
  • Data in AI training datasets is removed within 30 days
  • Trained AI models may retain learned patterns (see Privacy Policy Section 7 for details)

Third-Party Processors

Your data is processed by third parties including Microsoft Azure and Supabase. See our Privacy Policy Section 2 for details and safeguards.

8. Disclaimers and Assumptions of Risk

Educational Tool Limitation

  • AI feedback is not a substitute for human coaching, professional advice, or formal training
  • You assume all risk associated with relying on AI-generated assessments
  • Results are not guaranteed to improve professional performance

Platform Availability

  • We do not guarantee uptime or availability during the testing phase
  • The Platform may be unavailable for maintenance, updates, or unforeseen technical issues
  • We are not liable for damages from service interruptions

AI Accuracy

  • AI models may make mistakes, misunderstand context, or produce inappropriate responses
  • Assessment scores may not accurately reflect your actual communication abilities
  • We continuously work to improve accuracy but cannot guarantee perfection

9. Indemnification

You agree to indemnify, defend, and hold harmless Versa, its officers, employees, and agents from any claims, damages, losses, or costs arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you create or input on the Platform
  • Your breach of data protection responsibilities

10. Dispute Resolution

Informal Resolution

If a dispute arises, we encourage you to contact us first at support@versa.training to resolve the matter informally.

Governing Law

These Terms are governed by and construed in accordance with the laws of Austria, without regard to its conflict of law principles.

Jurisdiction

Any legal action or proceeding shall be subject to the exclusive jurisdiction of the courts located in Austria.

11. Modifications and Termination

Changes to Terms

We may update these Terms at any time. Material changes will be communicated via:

  • Email notice to your registered address
  • Prominent notice on the Platform
  • We recommend reviewing these Terms periodically

Your Options: If you disagree with changes:

  • Stop using the Platform
  • Request account deletion
  • Continued use constitutes acceptance of new terms

Termination Rights

We may terminate or suspend your account immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Input real sensitive personal data
  • Attempt to compromise Platform security
  • Engage in harassment or abusive behavior

You may request account termination at any time by contacting support@versa.training.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Versa regarding your use of the Platform and supersede all prior agreements, understandings, and communications.
